These Terms and Conditions (“Terms”) govern your access to and use of the Flowers and Favors website and services. By placing an order, you agree to be legally bound by these Terms.

If you do not agree, you must not use our services.

1 PRODUCTS

1.1 All products are subject to availability. We reserve the absolute right to substitute flowers, packaging, containers, or accessories with items of equal or greater value without prior notice.

1.2 Flower arrangements may be delivered in bud form to maximize freshness and longevity.

1.3 Due to the natural characteristics of flowers, variations in color, size, bloom stage, and design may occur. Such variations shall not constitute defects.

1.4 Product images on the website are for illustration purposes only. The final delivered product may vary in appearance.

1.5 We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to pricing errors, suspected fraud, or supply limitations.

2. PRICES

2.1 All prices are subject to change without prior notice, particularly during peak seasons including Valentine’s Day, Mother’s Day, and All Saints’ Day.

2.2 We reserve the right to correct pricing errors at any time, even after an order has been submitted. If a pricing error is identified, we may cancel the order and refund the payment.

2.3 Delivery charges are separate and are non-refundable once delivery has been attempted.

2.4 Taxes, fees, and bank transfer charges (if applicable) shall be borne by the customer.

3. ORDERS/PAYMENTS

3.1 The customer is solely responsible for providing complete, accurate, and correct sender and recipient information.

3.2 We shall not be liable for failed or delayed deliveries due to incorrect or incomplete information.

3.3 Orders are considered confirmed only upon receipt of full payment (except for approved Cash on Delivery transactions).

3.4 For bank transfers, orders will not be processed until payment has been verified.

3.5 We reserve the right to decline Cash on Delivery orders at our discretion.

4. DELIVERY

4.1 We shall make every reasonable effort to deliver orders within the timeframe requested by the Customer. All delivery times and time slots are estimates only, and we do not guarantee delivery at a specific time. Any selected time slot is a preferred delivery window; while we will make every reasonable effort to accommodate it, exact delivery cannot be guaranteed.

4.2 The Customer must ensure that the recipient is available on the requested delivery date. If delivery cannot be completed due to recipient unavailability or incorrect contact details, additional delivery charges may apply. No refund shall be issued for delivery costs already incurred.

4.3 We are not responsible for delays caused by:

  • Traffic conditions
  • Weather disturbances
  • Natural disasters
  • Public holidays
  • Government restrictions
  • Courier service disruptions
  • Force majeure events beyond our control

4.4 Delivery to hospitals, hotels, offices, condominiums, or similar establishments shall be deemed completed once accepted by any authorized personnel.

4.5 If the recipient is unavailable:

  • The order may be left in a safe location,
  • Released to a neighbor or authorized individual, or
  • Returned for redelivery at the customer’s expense.

4.6 If delivery fails due to recipient unavailability or incorrect details, additional delivery charges shall apply. No refund shall be issued.

5. CANCELLATION POLICY

5.1 Orders may not be cancelled or modified within 24 hours of the scheduled delivery date.

5.2 Same-day orders are strictly non-cancellable and non-refundable once processed.

5.3 Customized or personalized arrangements are strictly non-cancellable and non-refundable once preparation has begun.

6. COMPLAINTS

6.1 Due to the perishable nature of flowers, all complaints must be submitted within two (2) hours of delivery.

6.2 Complaints must include clear photographic or video evidence.

6.3 Failure to notify us within the required timeframe shall constitute acceptance of the product as satisfactory.

6. GENERAL

We shall ensure that we comply with the requirements of all current data protection legislation including, without limitation, the Data Protection, as replaced, modified or re-enacted from time to time. We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions.

7. Refund Policy:

At Flowers and Favors, we take pride in delivering fresh, quality floral arrangements. Due to the perishable nature of our products, the following policy applies:

7.1. Reporting Issues

1. Any complaint regarding product quality must be reported within two (2) hours from the time of delivery.

2. Complaints must include clear photographic or video evidence showing the condition of the product at the time of delivery.

3. Failure to report within the required period shall be deemed acceptance of the product in good condition.

7.2 Eligibility for Replacement or Refund

A replacement or refund may be granted only if:

  • The flowers were delivered in a visibly wilted, damaged, or deteriorated condition at the time of delivery; OR
  • The delivered product is materially different from the confirmed order.

Natural variations in flower color, size, bloom stage, and design due to seasonality shall not be considered defects.

7.3 Remedy Process

3.1 Replacement First Policy
Where possible, we will prioritize providing a replacement arrangement of equal value at no additional cost.

3.2 Refund
If replacement is not possible due to product unavailability or time constraints, a refund may be issued.

Refunds shall be processed using the original mode of payment, in accordance with applicable Philippine consumer protection laws.

3.3 Delivery fees are non-refundable once delivery has been successfully completed, except in cases where non-delivery is solely due to our fault.

7.4 Non-Refundable Situations

Refunds or replacements will not be provided if:

  • The recipient was unavailable at delivery.
  • Incorrect delivery details were provided.
  • Damage occurred after successful delivery.
  • The product was mishandled after receipt.
  • The design variation is within reasonable artistic interpretation.
  • The order was customized or personalized, unless the issue involves clear quality defects.

7.5. Failure to Deliver

If we are unable to deliver the order due to our fault, the customer may choose between:

  • Rescheduling the delivery; OR
  • Receiving a full refund.

8. LIMITATION OF LIABILITY

8.1 To the maximum extent permitted by law, our total liability shall not exceed the amount paid for the specific product purchased.

8.2 We shall not be liable for:

  • Indirect damages
  • Emotional distress
  • Loss of profits
  • Loss of opportunity
  • Consequential or incidental damages

8.3 We are not liable for allergic reactions or sensitivities related to flowers or related materials

9. FORCE MAJEURE

We shall not be liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, labor disputes, transportation interruptions, or supply shortages.

10. INTELLECTUAL PROPERTY

All website content, including images, text, logos, designs, and arrangements, are the property of Flowers and Favors and may not be copied, reproduced, distributed, or used without prior written consent.

11. DATA PRIVACY

We collect and process personal information solely for order fulfillment and customer service. By placing an order, you consent to such processing.

We may share necessary information with third-party couriers strictly for delivery purposes.

12. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the proper courts of Baguio City, Philippines.

13. AMENDMENTS

We reserve the right to amend or update these Terms at any time without prior notice. Continued use of our services constitutes acceptance of the revised Terms.
